Terms of Service

1. Acceptance of Terms

By registering for, accessing, browsing, or using the DazzleMarket website (located at dazzlemarket.in) or any related subdomains (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not use the Platform.

DazzleMarket is operated by Mad Falcon Enterprises (India) and its global subsidiary Mad Falcon Enterprises Pte Ltd (Singapore). References to "we," "us," or "our" mean Mad Falcon Enterprises.

2. Account Registration

To purchase or sell digital assets, you must create a verified account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for safeguarding your password and Two-Factor Authentication (2FA) credentials.

You may not share your account credentials with third parties. We reserve the right to instantly terminate or suspend any account suspected of fraudulent activities, credential sharing, or violating these Terms, without prior notice.

3. Terms for Buyers

When you purchase a digital asset (such as source code, themes, or plugins) on DazzleMarket, you are purchasing a License to use that asset, not the intellectual property rights to the asset itself.

• Payment: All payments are processed securely via third-party gateways (Stripe, Paytm, Easebuzz). You agree to pay the listed price plus any applicable government taxes (GST/VAT).
• No Resale: You are strictly prohibited from reselling, redistributing, or sub-licensing the raw source code "as is". The asset must be incorporated into a larger, distinct End Product.
• Refunds: Digital goods are inherently non-returnable. Refunds are only granted under strict conditions (e.g., malware, fundamentally broken code) as outlined in our Refund Policy. Buyer's remorse is not a valid reason for a refund.

4. Terms for Creators (Vendors)

If you register as a Seller/Creator, you enter into a binding commercial agreement with Mad Falcon Enterprises to distribute your digital assets through our Platform.

• Authorship: You must own the absolute copyright to every file you upload. Uploading stolen, nulled, or plagiarized content is a severe crime and will result in permanent bans and forfeiture of all pending payouts.
• Fees & Payouts: DazzleMarket charges a platform fee (commission) on every sale. Non-exclusive creators earn 70%, while Exclusive creators earn up to 90%. Payouts are subjected to a mandatory 30-day security clearance (escrow) to prevent chargeback fraud.
• Support Obligations: You are contractually obligated to provide 6 months of technical support to verified buyers. Failure to respond to support requests within 48 business hours may result in product suspension.

5. Intellectual Property & DMCA

We respect the intellectual property rights of others. If you believe your copyright-protected work was posted on DazzleMarket without authorization, you may submit a copyright infringement notification (DMCA notice) via our Report Abuse portal.

Upon receiving a valid DMCA notice, we will expeditiously remove or disable access to the infringing material. We enforce a strict "repeat infringer" policy and will terminate the accounts of creators who repeatedly violate IP laws.

6. Prohibited Conduct

You agree NOT to engage in any of the following activities on the Platform:

• Uploading files containing viruses, trojans, crypto-miners, or malicious backdoors.
• Attempting to bypass our security measures, DRM, or licensing verification systems.
• Using automated bots, scrapers, or spiders to extract data or source codes from the Platform.
• Filing fraudulent chargebacks with your credit card issuer to obtain assets for free.
• Harassing, threatening, or using abusive language towards creators, buyers, or our support staff.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Mad Falcon Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party (including creators) on the Platform; or (iii) any errors or bugs within the digital assets purchased.

The Platform and all digital assets are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in Narnaul, Haryana, India. For international B2B corporate disputes involving Mad Falcon Enterprises Pte Ltd, jurisdiction may fall under the laws of Singapore at our sole discretion.
